Penal Code from 26 November 1962

Legal Code Text

Article 489 – “Any person who commits lewd or unnatural acts with an individual of the same sex shall be punished with a term of imprisonment of between six months and three years and a fine of 120 to 1,000 dirhams, unless the facts of the case constitute aggravating circumstances.”

Article 483 – “Whoever commits an act of public indecency, whether by nudity or obscenity in his actions, shall be punished by imprisonment of one month to two years and a fine of 200 to 500 dirhams.”

Continues to criminalise under Penal Code (1963) Art. 489. A broader Penal Code reform process concluded in Nov. 2023; the Minister of Justice publicly confirmed Art. 489 would not be repealed. Enforcement continued through 2023 (multiple arrests documented).
